New Planning Rules Put Water on the Spot

England's rewritten planning framework raises fresh questions over water and drainage capacity keeping pace with housing.

England has a new National Planning Policy Framework, and planning lawyers are calling it the most substantial rewrite since 2012. Fresh chapters cover clean energy and water, flood risk and coastal change, and the natural environment, putting water infrastructure squarely inside the decision making process for new development.

Ben Standing, a planning partner at Browne Jacobson who advises public sector clients, described the shift bluntly: the framework replaces the carrot with the stick. Local authorities now face pressure to keep updating local plans or risk development landing wherever is cheapest rather than where infrastructure can support it. He pointed to recent droughts as proof that new reservoirs are overdue, and warned that water infrastructure lead times still run too long.

Will Thomas, a Browne Jacobson partner advising private sector clients, expects developers to welcome the added policy support for housebuilding. But he flagged a persistent problem underneath the enthusiasm: nobody has settled who pays for supporting infrastructure like water, education and transport alongside new homes. High quality delivery, he suggested, will need new financing models rather than relying on developers alone.

None of this touches nationally significant infrastructure projects, which still fall under the Planning Act 2008, though the new framework could still weigh as a material consideration there. The revision followed a consultation running from December through March, during which industry bodies pressed the point that housing ambitions were outrunning realistic drainage capacity. Water companies and drainage consultants should expect sharper scrutiny of how fast capacity commitments turn into approved connections.
